More on the Solomon Amendment case

As I posted Monday, I expect the government to lose the case in the Supreme Court involving the Solomon Amendment (Rumsfeld v. Forum For Academic and Institutional Rights) . Pejman Yousefzadeh disagrees. The funny thing is that Pejman believes that the Solomon Amendment "is both entirely consistent with the Constitution and good policy to boot." I agree. However, I don't think that will stop the Supreme Court from coming to the decision that five of the justices want to hand down.

Am I a cynic in regards to appellate jurisprudence? You bet.

MORE: Phillip Carter agrees with Pejman. They have more confidence in a correct result than I do.
